Terms of Service

These terms cover your use of the Eric's Home Serviceswebsite, customer portal, and mobile apps (the “Services”) and the services performed at your property. By booking service, signing an estimate, using our apps, or paying an invoice, you agree to these terms.

1. What we do

We are a licensed home-services contractor operating in Texas. We provide heating and cooling service, repair, replacement, and related work at customer properties. Our apps let you book service, view invoices, pay online, and communicate with us.

2. Estimates and pricing

  • Estimates are firm for 30 daysfrom the date they’re issued unless we specify otherwise on the estimate itself. After 30 days pricing may need to be re-quoted for material-cost changes.
  • Approving an estimate (electronically or in writing) authorizes us to perform the work described and bill you for the amount shown.
  • Additional workbeyond the approved estimate will be re-quoted before it’s performed, unless it’s an emergency (frozen line, active leak, unsafe condition) — in which case we’ll do what’s necessary to make the property safe and follow up with pricing as soon as possible.
  • Diagnostic fee. A trip / diagnostic fee applies to service calls; if you approve any repair the diagnostic fee is credited toward the repair.

3. Payment

  • Invoices are due on receipt unless otherwise noted. Late invoices may accrue a finance charge as permitted by Texas law.
  • We accept cash, check, and card (processed by Stripe). Card processing fees are absorbed by us on residential invoices under $500.
  • Financing is available for larger jobs through third-party lenders (currently Wisetack). Approval and terms are determined by the lender, not by us.
  • Deposits may be required on install jobs; deposits are refundable if we cancel, and non-refundable if you cancel after equipment has been ordered.

4. Warranty

  • Labor: we warrant our labor for two (2) years from the date of service on any repair or installation we perform. If a covered failure occurs, we return and correct it at no labor charge.
  • Parts and equipment:covered by the manufacturer’s warranty. Terms vary by manufacturer and are noted on the invoice or estimate. We’ll handle the claim on your behalf during our labor warranty period.
  • Not covered:damage from misuse, neglect, freezing, power surges, floods, storms, animal or pest damage, or work performed by another contractor. Filter changes are the owner’s responsibility unless a maintenance plan includes them.

5. Scheduling, cancellation, no-shows

  • Please give at least 24 hours’ notice to reschedule a non-emergency visit. Late cancellations or no-shows may be charged our trip fee.
  • We’ll send an on-the-way text before arrival. If nobody is home when we arrive at the confirmed window, we’ll wait 15 minutes then rebook (trip fee may apply).
  • Emergency service is available for existing customers outside business hours; after-hours rates apply.

6. Access, safety, and property

  • You must provide safe access to the equipment. If access requires moving furniture, removing pets, or securing an area, please do so before we arrive.
  • If we encounter a hazardous condition (mold, asbestos, live water, structural rot, active pests), we may stop work and require remediation by an appropriate specialist before continuing.

7. Communications

  • By providing a mobile number you consent to receive service-related text messages (appointment confirmations, on-the-way alerts, invoices). Reply STOP to opt out at any time; message and data rates may apply.
  • Marketing emails are opt-in and include an unsubscribe link on every message.

8. Acceptable use of our apps

You agree not to:

  • Attempt to access another customer’s account or data.
  • Reverse-engineer, decompile, or attempt to derive source from our apps except as permitted by law.
  • Use our apps to send spam, harass staff, or otherwise interfere with the Service.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to the Services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, lost business, or damage to property beyond the scope of the work we performed. Nothing in these terms limits our liability for gross negligence, fraud, or intentional misconduct.

10. Insurance

We carry general liability and workers’ compensation coverage in accordance with Texas law. A certificate of insurance is available on request.

11. Governing law and disputes

These terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in the county where our shop is based. Before filing a claim, please contact us at us so we have a chance to make it right.

12. Changes

We may update these terms as our services or the law change. Material changes will be posted on this page with a new effective date. Continued use of our services after the effective date constitutes acceptance.
